Firstly, it's crucial to understand what constitutes a specialty occupation. The H1-B visa is designed for roles that require a high level of expertise in a specific field. These occupations demand the theoretical and practical application of highly specialized knowledge.

To qualify as a specialty occupation, the position must meet at least one of these criteria:

A bachelor’s or higher degree or its equivalent is normally the minimum entry requirement for the position.
The degree requirement is common to the industry in parallel positions among similar organizations or, alternatively, the job is so complex or unique that it can only be performed by an individual with a degree.
The employer normally requires a degree or its equivalent for the position.
The nature of the specific duties is so specialized and complex that the knowledge required to perform them usually associates with attaining a bachelor’s or higher degree.

Educational Requirements for Eligibility
